Stolen Logo..

I was walking around in Bahja today after watching The underworld sequel in the cinema (It was cool btw) when I suddenly spotted something VERY familiar on the second floor!

The logo you see there was actually created by me from scratch back in July 2005 for a potential client in Oman but after a dispute the deal was cut off..But obviously the person went ahead and used my logo concept anyways after editing a few trivial things in it like some of the fonts , and elements within the aquarium..though the concept remains clearly the same.

I just couldn't believe how someone would stoop so low to actually steal my design without even informing me or asking my permission to actually edit it and use it! I have no idea who's credited for that now but I am surely not going to just stand by for others to be credited for my own hard work. I also have to mention that the owner of the shop shouldn't be blamed as the person who contacted me was assigned to find a logo and so I am quite sure the owner isn't aware of this 'theft'.

Anyways , here is my original Design created back in July 2005. I am glad I actually showed this to two of my friends before showing it to that client.

Focusing more on the Arabic text, I must say its almost the same.

Try talking to that guy, if the things didnt work, so I guess you can speak to the owner of the shop, at least he should know about the original source of his shop logo.

I am going to wait for the client's reply and have a talk with him/her , if that doesn't work out then I will contact the owner of the shop.

It is possible to get a legal consultant here in Oman, unlike what chulupu suggested.

Trowlers and Hamlins is one of them.

anyone who doesn't realize the similarities in both is blind...
who's the idiot who isn't ashamed of stealing other people's work?... s/he should show him/herself, and realize what a laughingstock s/he would be...

Is there really nothing called copyright in Oman? I would've at least thought there ought to be... if not sueing then at least obliging them to write or mention the original artist's name...

If it is actually true that the client stole Nabhan's logo, then he is entitled to compensation. He can sue him provided he has compelling evidence that the work is actually his (showed two of his friends before submitting it to the client-that's evidence), he can win. The emails that was run between them is evidence as well. If Nabhan (the plaintiff) did win, then the legal fee is paid by the 'defendant' or the person who stole the logo. The losing party always pays the legal fees for the whole case including his and his opponent's (Nabhan in this case)

Though I am doubtful now that I read the latest reply from the 'person who apparently stole Nabhan's logo'

If that's the truth as STING claims, then I am sorry, it seems that you don't have a strong case. If Dr.Diablo supports STING and actually says that he designed it from scratch based on the information STING gave him (email describing the way he wants the logo to be done), then STING has a point. It seems the concept was not yours to begin with because STING told you how he wants the logo to be done as in the fish inside the O or و. The Arabic font was copied, true but then that is trivial for it is not your font but a font on a public site.

That's my thoughts about the case.

lym : even if he described how he wanted the logo to look like..there is absolutely NO WAY that they'd end up looking almost identical. No two graphic designers think alike... that is a fact.

And so , he can claim whatever he wants but I am sure it is so obvious to anyone who sees it that the logo that is being used now is 100% based on mine. for heavens sake..even the glow and the bubbles are exactly the same.

It's a shame I lost all my emails in my old email account (DAMN hotmail!!) otherwise I am 100% sure he never mentioned anything about the Q..and only said that he wanted something built around the word "ahwadh" actually..and not the 'Q' in aquariums which came out later after i suggested something. ;)

I think it's pretty obvious who's lying and who isn't anyways. :p

Say you pick Trower and Hamlins or also Denton n Sapte which are the best around, they'll cost you a fortune and assuming you win (listen to Neo, he is a fox in this) is not worth
If you do it for a matter of principle as am doing with my case against that b!tch for example, then fair

Then I can say is that it's a shame that you don't have enough evidence. If you did, you could've won. He doesn't have to go to the most expensive lawyers to win. IF it's obvious, then I guess most lawyers can do the job.

A patent is the proof for registering an invention or a process. Artworks are protected by copyright, which is an automatic right arising upon the creation of the work. This doesn't meant that you have any proof though that you created this work at the time it actually happened.

Chulupu: yes I know it's you neo. :p ..thank you for stopping by and for your advice and comments..I appreciate them.

As I said before , I have no intention to bring this issue to the court room cause I am not that desperate besides I was told by many that it might cost me more than whatever compensation I might recieve so it's really not worth it to be honest..but I will do what I can to get credit for my work and I am positive that I will inshallah.

Locking the topic in ES is totally unfair ! u used ur privilege as a moderator in ES against ur opponent ! If, u wanted to discuss in ur blog from the beginning, then u should have not opened a topic in ES to begin with. u cant just have ur last say in that topic n then just lock it up, again am saying it is not fair.

Insha'Allah you get credit for your creation....

Don't go to court, it isn't worth the effort, moreover you don't have much of a chance, as blue_chi said, artwork in Oman needs to be protected by a patent.

Devilish: unfair? hmm.. perhaps but as an admin I had to stop the flaming which sting caused after mentioning all the details in it. and so I don't feel bad about locking it at all since I knew he would have never stopped. sooner or later i would have still had the last say and ended up locking it.
